Terms of sale and product pricing on the Site may be different from those at the Éfémer bijoux boutique, located in Gatineau, Quebec. The Site and boutique are separate entities and have different operating criteria for which Éfémer bijoux will not provide any justification. You are free to make purchases on the Site or in person at the boutique. However, you are bound by the terms, conditions and policies effective at the point of sale you have chosen.

 

Éfémer bijoux operates the Site from its offices located in Canada. Éfémer bijoux does not make any assertions regarding the use of the Site outside of Canada. However, the Site may not be accessed from any territory in which the Site’s contents or use is deemed illegal. Persons who decide to use the Site do so of their own free will and must adhere to any applicable laws in their jurisdiction. Any claim relating to the Site, its contents or its use will be adjudicated under the laws of the Province of Ontario, Canada, where Éfémer bijoux is incorporated.

1.2 Trademarks and usage restrictions

You may print pages from the Site. However, you may not modify the pages in any way or delete or alter any visible or invisible identifying mark, brand, notice or disclaimer of responsibility. You are prohibited from copying, imitating, reproducing, republishing, downloading, posting, transmitting, modifying, indexing or cataloguing the Site, in any way whatsoever, in whole or in part, without the express written consent of Éfémer bijoux.

1.3 Limitation of liability

The Site and its contents are provided as is, without any implicit or explicit warranty. Notwithstanding any public policy statute to the contrary, Éfémer bijoux disclaims itself from any liability and provides no warranties, including regarding the merchantability of products or their fitness for any given use. Éfémer bijoux makes no assertions regarding the use, validity, accuracy or reliability of any elements presented on the Site, and makes no assertions regarding results from the use of such elements. Éfémer bijoux’s affiliates, officers, employees, representatives and agents will not, under any circumstances, be held liable for any damages directly or indirectly related to the Site’s use, including any loss of data or profit related to the use, or the unavailability, of the Site’s elements.

Efemer.com provides links to other websites we deem relevant. These websites are not operated by Éfémer bijoux or efemer.com.Upon accessing these sites, you will leave efemer.com, thus ending our obligations to you. Éfémer bijoux has no control over other sites and is not responsible for their activities, products, services or contents. We disclaim ourselves from any liability regarding the information provided by these sites, and we recommend that you read their privacy policies carefully. 

As a user of the Site, you acknowledge that any element, information or opinion you provide to Éfémer bijoux through any means will become the exclusive property of Éfémer bijoux, and you relinquish any moral right regarding such material. Éfémer bijoux may use, duplicate, publish or license, in any way and through any means, material you provide, and do so without compensating you in any way. Furthermore, you are forbidden from sending Éfémer bijoux material of an illegal, defamatory, obscene or unlawful nature. By sending material to Éfémer bijoux, you assert that you are the holder of all rights relating to such material, including intellectual property rights. Éfémer bijoux reserves the right to remove or to refuse to publish any material you have provided, at its sole discretion, for any reason whatsoever.

Any information you provide while using the Site, including registration information (name and email address) and payment information (credit card number and expiry date), as well as any other information you provide in the course of a transaction, must be true, accurate, up-to-date and complete. Éfémer bijoux relies on the information you provide. You will bear sole responsibility for any loss, damage or additional costs incurred by you, Éfémer bijoux or any other person because of false, inaccurate, incorrect or incomplete information you have provided, or because you have failed to update your registration information or your credit card information within thirty (30) days after a change in that information has occurred.

Éfémer bijoux reserves the right to amend this policy at any time. Éfémer bijoux also reserves the right to release your personal information in instances where it is required by law or in order to protect its property rights regarding the Site or the rights of its users, sponsors, advertisers or suppliers. 

Upon receiving an order placed on the Site, Éfémer bijoux sends an email confirmation to the client. However, this confirmation does not mean that Éfémer bijoux has accepted the order or that Éfémer bijoux agrees to proceed with the transaction. Éfémer bijoux reserves the right, without any further notice, to refuse to do business with any client or to set maximum quantities. Éfémer bijoux may have to verify personal or credit card information before accepting an order.

2.2.5 Prices on the Site may not be the same as prices for the same products sold at the Éfémer bijoux boutique.

2.3.3 We only accept personal cheques if they are certified by your financial institution.

2.4.1 (a)1 You have 15 days from the shipping date (30 days for clients in the United States of America or other countries) to send us an email at purchase@efemer.com  and request a return authorization number for any item you wish to return. The item must show no sign of having been used or worn.

Items returned for refund must be accompanied by a copy of the invoice and a return authorization number. If all foregoing conditions are met, you will not have to provide any explanation to Éfémer bijoux and you will receive a full refund. However, shipping fees will not be refunded. Our free shipping offer on orders over $160 becomes void if the order is returned for a refund. The shipping fees will be deducted from the refund amount.

2.4.1 (a)3 Customers from Canada: When returning an item for reasons other than damage noted upon delivery or an error made by Éfémer bijoux, you must pay for packaging and insured shipping, and assume the risk that the item may be damaged during the return process.

If Éfémer bijoux has sent you the wrong item, we will rectify the order and send you the correct item.

2.4.4 Purchases of items on sale are final. No refunds or exchanges are provided. If you return such an item, we will send it back to you at your expense.

2.5.3 Éfémer bijoux shall not be held liable for any damage you may incur because of item unavailability.

2.6.8 Éfémer bijoux must be paid in full before initiating delivery of an item.

2.7.2 However, the foregoing clause does not limit consumer rights you may have by virtue of any applicable public policy statute.

Éfémer bijoux will follow up with its suppliers when repairs are undertaken. In any case, you must provide a copy of the invoice, which can be accessed online through your customer account. The invoice is your warranty card, since it provides the date of purchase. All products are covered by the manufacturer’s warranty. Warranty periods and inclusions depend on the product and the brand.

Warranties for the products sold through Éfémer bijoux Inc. do not cover:
- Parts that need to be replaced from time to time (batteries, bracelets, crystal, etc.);
- Abnormal or non recommended use. Please read all instructions carefully;
- Damage caused by an unskilled technician; or
- Damage caused by an accident, an impact, immersion in a liquid or any other external cause.

Éfémer bijoux shall not be held liable for instances in which a manufacturer declines to honour its warranty because of the above-noted exclusions. If a repair is not covered by the warranty, Éfémer bijoux will obtain an estimate from the manufacturer and forward it to you for approval.

2.9 Force majeure

Éfémer bijoux shall not be held liable for its omission to perform its obligations to you, in whole or in part, or for any damage or loss you may incur if the omission, damage or loss is caused by force majeure or circumstances beyond Éfémer bijoux’s control.
